Terms & Conditions
These terms explain what to expect when you use SpeedPress's WordPress maintenance, speed optimization, security, and support services — please read them before subscribing to any plan.
Introduction
By subscribing to or using any SpeedPress service plan, you ("Client," "you") agree to be bound by these Terms & Conditions ("Terms"), entered into with SpeedPress ("we," "us," "our"). If you do not agree to these Terms, please do not subscribe to or use our services.
We may update these Terms from time to time to reflect changes in our services or legal requirements. Continued use of our services after an update means you accept the revised Terms. Material changes will be communicated by email at least 7 days before taking effect.
Services & Scope
SpeedPress provides WordPress maintenance, WooCommerce maintenance, speed optimization, security & malware removal, emergency support, and custom development services ("Services"). The exact features included depend on the specific plan you subscribe to, as described on the relevant service page at the time of purchase.
Unless explicitly stated in your plan, the following applies across all Services:

- Core, theme & plugin updates (tested before applied)
- Scheduled backups, stored off-site
- Uptime & security monitoring
- Monthly health/performance report
- Support via email / WhatsApp during stated hours
🚫 NOT INCLUDED (UNLESS QUOTED SEPARATELY)
- New design work, redesigns, or new page builds
- Custom feature development outside the agreed scope
- Content writing, product uploads, or data entry
- Third-party plugin/theme license fees
- Recovery from changes made by the Client or a third party without our involvement
Note: If your site is already compromised, misconfigured, or has unresolved issues before your plan begins, an initial cleanup fee may apply — this will always be quoted and agreed to before any work starts.
Client Responsibilities
To keep your Services running smoothly, you agree to the following responsibilities as the Client:
Provide accurate account & access info
Keep your contact, billing, and website access details (hosting, WordPress admin, FTP/SSH) accurate and up to date, and provide access promptly when requested.
Keep your own backup copy
We perform scheduled backups as part of your plan, but you remain responsible for independently verifying and retaining your own copy of critical data.
Tell us about direct changes
If you or a third party install plugins/themes or edit the site directly without us, let us know beforehand — undisclosed changes can cause conflicts we can't be held responsible for.
Legal use of your website
You're responsible for ensuring your website's content complies with applicable laws and doesn't infringe on third-party rights. We don't review content for legality.
Website ownership & eligibility
Only websites you own or are authorized to manage, and that haven't been altered by an unauthorized third party, are eligible for support under these Terms.
Timely payment
Keep your payment method valid and pay invoices on time — late payments may affect the response times and guarantees described elsewhere in these Terms.
Note: If information you provide is inaccurate or access isn't granted in time, response times and guarantees described in these Terms may be delayed accordingly, through no fault of ours.
Payment & Billing
Subscription plans are billed in advance on a recurring basis. By subscribing, you authorize us to charge your chosen payment method automatically each billing cycle until you cancel.
- All prices are listed in [Currency] and are exclusive of applicable taxes unless stated otherwise; you're responsible for any taxes owed on your purchase.
- If payment isn't received within the grace period, we may suspend Services until the outstanding balance is paid — suspension doesn't cancel or waive fees owed.
- We may update our pricing for future billing cycles with at least 30 days' notice by email; continuing to use the Services after that date means you accept the new pricing.
- Upgrades or downgrades to your plan take effect from your next billing cycle, unless otherwise agreed in writing.
- One-time services (e.g. emergency fixes or initial cleanup outside your plan) are quoted and invoiced separately, and are due before or upon completion of the work as agreed.
Note: Accepted payment methods, exact invoice due dates, and applicable taxes may vary by region — the specific details for your account will be confirmed at checkout or in your invoice.
Cancellation & Refunds
There are no long-term contracts on any subscription plan. You may cancel at any time by emailing us or through your account dashboard, effective at the end of your current paid billing cycle.
- Since billing is in advance, we don't provide partial refunds for the unused portion of a billing cycle once it has started.
- Speed Optimization plans: if we don't improve your PageSpeed score by at least 20 points, you may request a full refund within 14 days of the optimization being completed, as described on the Speed Optimization service page.
- One-time project fees and deposits become non-refundable once work has started, unless otherwise agreed in writing beforehand.
- Emergency support fees are non-refundable once the requested work has been performed.
- After cancellation, you may request an export of your most recent backups within 30 days; after this period, we may delete stored backups and account data.
- If you cancel and later resubscribe after your site has gone unmaintained, a re-audit fee may apply before regular maintenance resumes.
Note: The Speed Optimization guarantee applies only to the specific pages/scope covered in that optimization, and assumes no unrelated changes were made to the site afterward.
Liability Limitation
Services are provided "as is" and "as available," without warranties of any kind, express or implied, including — but not limited to — implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We take reasonable, industry-standard measures to keep your website updated, backed up, and secure. However, we don't guarantee that your website will be free of all bugs, vulnerabilities, or downtime — no maintenance or security service can promise that, given how fast plugins, themes, hosting environments, and online threats change.
To the maximum extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, sales, or business opportunities — arising from your use of, or inability to use, our Services.
Total liability cap
Our total liability for any claim relating to the Services is limited to the total fees you paid us in the 3 months immediately before the event giving rise to the claim.
We're not responsible for issues caused by:
- Bugs or vulnerabilities in third-party plugins, themes, or integrations we did not develop
- Outages, misconfiguration, or failures at your hosting provider, domain registrar, or any third-party service
- Changes made directly to your website by you or an unauthorized third party without notifying us
- Events outside our reasonable control (force majeure), including natural disasters, internet/network outages, or government action
- Pre-existing issues on your website that existed before your plan began
Our "if we break it, we fix it" guarantee (described on our service pages) covers repairing the specific issue our work caused — it does not extend to indirect losses such as lost sales during downtime.
Confidentiality & Data
Performing your Services requires access to sensitive information — your website admin, hosting, and, for WooCommerce plans, order and customer data. Both parties agree to keep all access credentials and private information confidential, and not share them with any unauthorized parties.
✅ WHAT WE DO
- Access your site/data only as needed to perform the Services you've subscribed to
- Store backups securely, off-site, with reputable storage providers
- Require anyone on our team with access to your site to follow the same confidentiality obligations
- Delete stored access credentials and backups after the retention period described in Section 5
🚫 WHAT WE WILL NEVER DO
- Sell your data, customer data, or order data to any third party
- Share your customer/order data with marketers or unrelated third parties
- Use your website content or data for anything beyond delivering your Services
- Access your site outside the scope of your active plan
Where legally applicable, you remain the data controller of any personal data on your website (including customer and order data), and we act as a data processor solely for the purpose of delivering the Services. Full details on how we handle personal data are set out in our separate Privacy Policy.
Note: We may disclose information if legally required to do so (e.g. a valid court order), but will notify you first unless prohibited by law from doing so.
Service Guarantees
This section brings together the specific guarantees referenced across our service pages, along with the conditions that apply to each.
"If we break it, we fix it"
If an update we perform causes an issue, we'll fix it at no extra charge — provided it's reported within 7 days and no unrelated changes were made afterward. See Section 6 for scope.
+20 PageSpeed score, or refund
If your PageSpeed score doesn't improve by at least 20 points after optimization, you may request a full refund within 14 days. See Section 5 for the refund process.
We watch — we don't control hosting
We monitor your site around the clock and alert you to downtime, but we can't guarantee 100% uptime, since that also depends on your hosting provider. See Section 6.
Response time commitments
Business-plan clients get 24/7 emergency response within 1 hour. Other plans get priority response during business hours (avg. ~15 min via WhatsApp) — not a 24/7 guarantee.
These guarantees do not apply if:
- You or an unauthorized third party made direct changes to the site without notifying us (Section 3)
- Your site uses pirated/nulled plugins or themes
- The issue was caused by your hosting provider, domain registrar, or another third-party service
- Your account was suspended for non-payment at the time the issue occurred
Termination
Beyond your own right to cancel (Section 5), we may suspend or terminate your access to the Services, with or without prior notice, under the circumstances below.
WE MAY SUSPEND OR TERMINATE IF:
- You breach any part of these Terms and don't correct it after being notified
- Payment remains overdue past the grace period described in Section 4
- Your website is used for illegal activity, malware distribution, or to harm others
- You or your representatives are abusive or threatening toward our team
- You provided false information when subscribing to the Services
WHAT HAPPENS AFTER TERMINATION:
- You remain responsible for any outstanding fees up to the termination date
- Sections that by nature should continue — confidentiality, liability limitation, payment obligations — survive termination
- We'll provide a final backup export where reasonably possible, per Section 5's retention window
- For severe breaches (e.g. illegal activity), we may withhold transition assistance and pursue further action
Note: Termination for cause doesn't entitle you to a refund for the current billing cycle, and doesn't waive any fees already owed.
Governing Law
These Terms are governed by and construed in accordance with the laws of [Country/State], without regard to its conflict of law principles.
If a disagreement arises, we ask that you first contact us directly so we can try to resolve it informally. If it can't be resolved this way, any dispute relating to these Terms will be subject to the exclusive jurisdiction of the courts of [Location], except where local consumer protection law requires otherwise.
These Terms, together with our Privacy Policy and any service-specific terms referenced on our website, represent the entire agreement between you and SpeedPress regarding the Services, and supersede any prior agreements on this subject.
